Wal-Mart’s Profits Aren’t The Only Thing Falling

There is no corporate entity that gets my blood boiling more than Walmart. Sure, I could hate Haliburton more, but the fact that Walmart pretends to be the BFF of every red-blooded American man, woman and child while secretly raping them fiscally and socially really grinds my gears. Call it childish, but I love hearing when Walmart is failing at something–anything really.. Sadly, in my logical heart-of-hearts, I know this means the economy must be doing really badly if Walmart isn’t hitting financial goals.
But one other piece of Walmart news caught my eye today. In 2007, the Ninth Circuit Court of Appeals upheld the trial court’s decision to certify a class of women for class action against Walmart based on sexually discriminatory practices. That small victory signaled a shift in the tides for workers looking to make good on the promises Walmart made to them.
Today the Wall Street Journal reported that this decision might be reversed:
The full appeals court will now revisit the contentious case, which began in 2001 when a 54-year-old Wal-Mart employee from California named Betty Dukes filed a sexual discrimination claim against the world’s largest retailer, alleging that she was denied the training needed to obtain a higher-paying job because of her sex.
The case subsequently grew to include 2 million women who have worked at Wal-Mart since December of 1998, which lawyers say makes it among the largest class-action sexual discrimination cases in the country. The current legal exposure for Wal-Mart is in the billions of dollars, given the size of the class, according to some of the attorneys involved.
If the Ninth Circuit Court of Appeals overturns the decision, millions of female Walmart workers everywhere will not be represented in the suit and Walmart will be allowed to continue their historically sexist practices.
If it’s one thing women do not need, it’s another setback. This goes double for women that work at Walmart. Here’s to hoping that the Ninth Circuit does the right thing en banc.

Yes, sexual discrimination is wrong. But that's as far as I will agree. If I couldn't do my grocery shopping at WalMart, and had to shop at a grocery store, I would be coming home with 25% fewer groceries. Thank God for WalMart!
